The City of Tshwane will issue licences or permits to qualifying spaza shops to comply with municipal health, fire safety and town planning regulations.
Registration process
You can register your spaza shop at the Business Licencing Section at the Middestad Building or online at https://opendata.tshwane.gov.za/Spazaregister/app-registration.
Documents needed for this process:
- Application form
- Identity document for residents of South Africa or Home Affairs documents for foreigners (certified copies)
- Locality plan
- Land use plan
- Site plan, building plan or sketch plan (A4)
- Registration with the Companies and Intellectual Property Commission (CIPC)
- Copy of title deed, lease agreement or proof of residence
- Appropriate zoning certificate
- Affidavit and certified copy of identity document of stand or erf owner if property is zoned as Residential 5
- Proof of ownership of business property
- Menu, in the case of a restaurant
- Tax clearance certificate (South African Revenue Service (SARS) documents)
- Additionally, in terms of the Immigration Act, 2002 (Act 13 of 2002), foreign nationals are expected to provide proof of a R5 million investment, in terms of a bank statement, into an existing business in South Africa as well as a business visa
Proof of ownership of business property:
- Property owned by the City of Tshwane: The Special Power of Attorney must be obtained from City Manager through Group Property (located at Ou Raadsaal or Tshwane House)
- Property owned by the Republic of South Africa: The Special Power of Attorney must be obtained from the Department of Public Works.
- Property owned by the Minister of Rural Development and Land Affairs in trust for AmaNdebele: The company resolution must be signed by the AmaNdebele Tribal Authority and the Special Power of Attorney must be obtained from the Minister of Rural Development and Land Affairs.
After submitting the documents, the City will review the documents for compliance. This process will take time and applicants will be informed of the outcome.
Issuing of trade licences
- A trade licence will be issued after the registration approval.
- The applicant must pay the application fees at a municipal pay point.
- Proof of payment must be submitted to the Business Licencing Section at the Middestad Building. The licence will then be issued.
